As Artificial Intelligence driven initiatives, products and competitors increase, risk disclosures will also grow, however, we are at the beginning of these disclosures. Informal research published by Weil, Gotshal & Manges LLP in November showed that “approximately 6% of S&P 500 companies and 5% of Russell 3000 companies made disclosure relating to AI in the notes to the financial statements.” in 2023. DelCreo expects this trend to accelerate in upcoming filings.
Several companies, including Meta and Alteryx have disclosed an overall AI related risk in their 10k Risk Disclosures: “We may not be successful in our artificial intelligence initiatives, which could adversely affect our business, reputation, or financial results”
Other disclosures tended to describe the impact of AI on previously disclosed risk areas. Companies might consider AI related disclosures in areas such as privacy, cybersecurity, system failures, reputation, competition, intellectual property ownership and infringement, and third parties, products liability, labor and employment, insurance, consumer protection, corporate governance, national security, ethics, government policy, and regulation.
Based on these disclosures and other research, AI risks to consider adding to your existing risk universe or inventory include:
